COVID–19 Public Health Response Act 2020:
Part 1: Implications for free and informed choice regarding vaccination and medical testing and treatment: Submissions due by Sunday 27 June
During the COVID-19 lockdown the NZ government passed the COVID-19 Public Health Response Act 2020.

There was no call for submissions at the time of the bill, which was rushed through under urgency, but the bill is now open for submissions.
The final closing date for submissions is Sunday, 28 June 2020. At this stage the committee is accepting only written submissions. (The deadline for oral submissions was 7 June 2020 – I apologise for not noticing the two different dates in time to alert you earlier – and for the short notice for written submissions.)

Please note that I am not a lawyer so none of what I have written below should be considered to be a legal opinion.
The COVID-19 Public Health Response Act 2020 Act does not mention vaccination. However, to quote from (a) from Section 11 of the Act (http://www.legislation.govt.nz/act/public/2020/0012/latest/LMS344177.html ) the Minister or the Director-General “may make an order” for “1 or more of the following purposes” including to “require persons to take any specified actions, or comply with any specified measures, that contribute or are likely to contribute to preventing the risk of the outbreak or spread of COVID-19…”
Section 11 of the Act goes on to specify a long list of specified actions, which I have copied in full at the end of this newsletter.
The full text of Clause (a) of Section 11 is:
“to require persons to refrain from taking any specified actions that contribute or are likely to contribute to the risk of the outbreak or spread of COVID-19, or require persons to take any specified actions, or comply with any specified measures, that contribute or are likely to contribute to preventing the risk of the outbreak or spread of COVID-19, including (without limitation) requiring persons to do any of the following:”
I have highlighted the words “without limitation” as I believe that the inclusion of these words makes the potential meaning of this Section of the Act so broad that it could be used to encompass the mandating of vaccination should the government decide that compulsory vaccination should be part of its response to COVID-19.
Also of concern is that Under “11 Orders that can be made under this Act” (I have copied this section in full at the end of this newsletter) people could be required to:
“report for medical examination or testing in any specified way or in any specified circumstances” (viii) This is obviously in conflict with the human right to make decisions about one’s own medical care.
Also of concern is the fact that Part 19 suggests that “enforcement officers” for the Act need not necessarily be police officers:
Subpart 3—Enforcement, offences, and penalties
18 Authorised persons
Suggests that an “authorised person” for the purposes of this bill could be a very wide range of people. I wonder whether this clause could even enable military personnel to be engaged for the purposes of acting as “enforcement officers” for the Act.
While I am not condoning the actions of people who were newly arrived in NZ who have reportedly recently broken the agreements that they made to stay in quarantine, it is a concern that the military has now been brought in to manage quarantine in NZ. https://www.nzherald.co.nz/nz/news/article.cfm?c_id=1&objectid=12340991
Part 2: Political responses to the COVID-19 Public Health Response Act
Petition of Linda Dalgleish
Linda Dalgleish initiated a petition on the website of NZ’s parliament asking for the COVID-19 Public Health Response Act to be repealed. https://www.parliament.nz/en/pb/petitions/document/PET_97806/petition-of-linda-dalgleish-we-do-not-want-the-covid-19
Her petition has reportedly been presented to parliament’s Finance and Expenditure Committee but I am unsure of what result may have come of this.
(It is also interesting to note that a petition on change.org (which is attributed to the following Facebook group https://www.facebook.com/groups/235857037702047/ ) has attracted more than 65,000 signatures. The petition is here:

Petition against mandatory vaccination by MP Jami-Lee Ross
Jami-Lee Ross MP for South-East Auckland’s Botany electorate recently initiated a petition against compulsory vaccination. Based on the text on his petition website, Jami-Lee Ross is also concerned that Section 11 of the COVID-19 Public Health Response Act could be used to institute compulsory vaccination with a COVID-19 vaccine.
Specifically his concerns relate to the following text:
“require persons to take any specified actions, or comply with any specified measures, that contribute or are likely to contribute to preventing the risk of the outbreak or spread of COVID-19, including (without limitation) requiring persons to do any of the following”.

In a recent Facebook video (https://www.facebook.com/jamileeross/videos/1144104522649355/), Jami-Lee Ross includes footage of his attempt to table an amendment to the 2020 COVID-19 Public Health Response Act designed to protect people from being vaccinated against their will and to ensure that children would not be vaccinated unless their guardian had given consent in writing:
The text of his amendment is below:
“No order made under this Act may require a person to be vaccinated in any form without that person’s written consent first being obtained or, in the case of a child, the written consent of that child’s guardian first being obtained.”
As an objection was raised to the tabling of this amendment it seems unlikely that the amendment will be incorporated into the law.

The film Vaxxed II is now available online and according to a friend who has watched it, it is an excellent documentary that focuses on how vaccine-injury impacts on individuals and their families. Vaxxed had some screenings in NZ cinemas and if I learn of a similar initiative for Vaxxed II I will share this information via this newsletter or our FB page.

Dr. Judy Wilyman’s PhD these examined the Australian vaccination schedule. She also runs the website http://vaccinationdecisions.net/ and sends out regular newsletters on the vaccination issue.
